DOJ Objects to Steward’s Bankruptcy Proceedings

Government Alleges Antitrust Violations

Washington, D.C. – The United States Department of Justice (DOJ) has filed an objection to the bankruptcy proceedings of Steward Health Care System LLC (Steward). The DOJ alleges that Steward engaged in anticompetitive practices, including acquiring hospitals in competitive markets and using its dominant position to raise prices and reduce competition. “Steward’s conduct has harmed consumers and healthcare providers in the markets where it operates,” said Jonathan Kanter, Assistant Attorney General of the DOJ’s Antitrust Division. “The Department is committed to protecting competition and ensuring that consumers have access to affordable, high-quality healthcare.” Steward, which operates more than 30 hospitals in the United States, filed for bankruptcy protection in July 2022. The DOJ’s objection seeks to prevent Steward from using bankruptcy to avoid liability for its alleged antitrust violations. The DOJ’s action is part of its ongoing efforts to address anticompetitive practices in the healthcare industry. In recent years, the agency has filed lawsuits against several large hospital operators for engaging in similar conduct.
